Judge trumps KHRC
A Franklin County judge has issued an injunction in the six day suspension of jockey Javier Castellano. The KHRC had suspended Castellano for careless riding in the Breeders’ Cup Marathon. After the race, Castellano and jockey Calvin Borel got into a fistfight in the winner’s circle.
Castallano had requested a stay with the KHRC in order to ride in another stakes race. However, Executive Director Lisa Underwood denied the stay. The commission staff wanted the suspension to be immediate but the court ruled that if the commission’s executive director denies a stay, due process requires the full commission to meet on the issue if the person does not agree with the executive director’s decision.
