Instant Racing decision may be near

The Supreme Court of Kentucky is scheduled to release opinions on Thursday, February 20, 2014. Many have speculated that it will include the "Instant Racing" decision that horseman have been anxiously awaiting.


The SCOKY heard arguments in the case on August 21, 2013. The parties argued whether a Franklin Circuit Court erred by not allowing attorneys for the Family Foundation of Kentucky to conduct a pre-trial discovery as part of that organization's challenge to the Kentucky Horse Racing Commission's approval of historical race wagering at the state's tracks.

Meanwhile, the Instant Racing machines at the two tracks who currently have them installed seen some of their largest wagering gains during last month. In January 2014 a total of 26.13 million was wagered - an increase of 39 percent over the previous January.
